Welcome to the West Oak Photography LLC website (“Website”). By accessing or using this Website, booking sessions, entering giveaways, or purchasing gift certificates, you (“Client,” “you”) agree to these Website Terms & Conditions. If you do not agree, please do not use this Website.

1. Contractual Agreement

All photography sessions and services are governed by the West Oak Photography Photography Services Agreement (“Contract”), which all Clients must sign prior to their session. These Website Terms & Conditions supplement but do not replace the full Contract. By booking through this Website, you acknowledge that you will be required to sign the full Contract.

2. Website Use

  • You agree to use the Website lawfully and not engage in disruptive or harmful behavior.

  • You agree not to upload or share any content that is illegal, infringing, or harmful.

  • All Website content, including images, text, logos, and designs, is owned by West Oak Photography LLC and protected by copyright law.

3. Privacy

Your use of this Website is also governed by our Privacy Policy. By using the Website, you consent to our collection and use of personal information as described therein.

4. Gift Certificates

  • Gift certificates include a standard session fee and any specified credit but do not include prints, digital files, or products unless stated.

  • A $100 refundable deposit may be required to secure booking.

  • Cannot be combined with other promotions, contests, or discounts.

  • Valid only for the items and services listed on the certificate.

  • Not transferable or redeemable for cash.

  • Valid for one session per household, within 30 miles of Whitmore Lake, Michigan, unless otherwise agreed.

  • Valid for five years from purchase date (or shorter if purchased at discount or promotion).

  • Must be registered and used before expiry.

  • Cancellation and no-show policies apply and may result in forfeiture of the certificate value.

5. Intellectual Property

  • Website content is owned by West Oak Photography LLC.

  • Unauthorized copying, reproduction, or distribution of Website content is prohibited.

6. Limitation of Liability

  • West Oak Photography LLC is not responsible for damages arising from Website use except for gross negligence or willful misconduct.

  • We do not guarantee uninterrupted or error-free Website access.

7. Links to Third Parties

The Website may contain links to third-party sites. We are not responsible for their content or practices.

8. Modifications

West Oak Photography LLC reserves the right to update or modify these Terms at any time. Continued use of the Website after changes indicates acceptance.

9. Governing Law and Dispute Resolution

These Terms are governed by Michigan law. Disputes relating to Website use shall be resolved according to the terms in your signed Photography Services Agreement.

10. Severability

If any provision is found invalid or unenforceable, the remainder will continue in full force.
