Welcome to West Oak Photography LLC. These Terms & Conditions apply when you access or use this website, submit an inquiry, book a photography session, participate in a promotion or giveaway, purchase a gift certificate, purchase a promotional session offer, or complete a purchase through a payment page provided by West Oak Photography LLC.By using this website or completing a purchase, you (“Client,” “you”) agree to these Terms & Conditions.
1. Photography Sessions and Client Agreement
Photography sessions are governed by the client agreement provided by West Oak Photography LLC for the applicable session.Clients may be required to review and sign that agreement before their scheduled session. These Terms & Conditions supplement, but do not replace, the terms of any separately signed client agreement.If a conflict exists between these Terms & Conditions and a signed client agreement concerning a booked photography session, the signed client agreement will control with respect to that session.
2. Session Reservations
West Oak Photography LLC may require a reservation payment to secure or purchase access to a photography session.Reservation amounts may vary depending on the type of session, promotion, returning-client benefit, or other offer.Payment of a session reservation does not include artwork, digital photographs, prints, albums, folio boxes, or other products unless specifically stated in the applicable offer.No artwork purchase is required unless expressly stated otherwise.Once a Client selects a session date, cancellation, rescheduling, weather, attendance, and other session-related policies are governed by the applicable client agreement.
3. Website Use and Intellectual Property
You agree to use this website only for lawful purposes and not to interfere with its operation or security.All photographs, text, logos, graphics, designs, branding elements, and other content displayed on this website are owned by or licensed to West Oak Photography LLC and are protected by applicable copyright and intellectual property laws.Website content may not be copied, reproduced, distributed, modified, published, or used for commercial purposes without prior written permission from West Oak Photography LLC.
4. Purchased Gift Certificates
4.1 Definition
A purchased gift certificate is a certificate or stored-value credit for which a customer pays West Oak Photography LLC a stated monetary amount for future eligible goods or services.Purchased gift certificates are separate from promotional session offers, complimentary certificates, giveaway prizes, charitable donations, and other promotional benefits.
4.2 Redemption
Purchased gift certificates may be redeemed toward eligible photography services, artwork, products, or other purchases offered by West Oak Photography LLC, subject to any restrictions disclosed at the time of purchase.Purchased gift certificates may not be used to purchase additional gift certificates.Purchased gift certificates are not redeemable for cash except where required by law.
4.3 Expiration
Purchased gift certificates will remain valid for at least the period required by applicable law.Any expiration date or other time restriction will be disclosed at the time of purchase and will comply with applicable law.
4.4 Fees
West Oak Photography LLC does not deduct inactivity or service fees from the remaining value of a purchased gift certificate.
4.5 Terms at Time of Purchase
Material restrictions or conditions applicable to a purchased gift certificate will be disclosed at the time of purchase.Terms applicable to a purchased gift certificate will not be changed after purchase except where permitted or required by law.
4.6 Lost or Unavailable Certificates
Customers should retain their gift certificate information.If a purchased gift certificate is lost or unavailable, West Oak Photography LLC may attempt to verify the purchase through available business records, including payment records, purchaser information, recipient information, and certificate records.Replacement or reinstatement is subject to verification and applicable law.
5. Complimentary Promotions, Giveaways, and Donated Certificates
5.1 Definition
West Oak Photography LLC may provide complimentary certificates, credits, prizes, or other benefits for which the recipient did not make a direct payment to West Oak Photography LLC.These may include giveaway prizes, charitable donations, auction certificates, promotional awards, and complimentary session certificates.
5.2 Terms
Unless otherwise stated in the applicable offer, complimentary promotional benefits:are valid only for the services, artwork, credit, or other benefits expressly stated;have no cash value;may not be redeemed for cash;may not be combined with another promotion, discount, contest, certificate, or credit unless expressly permitted;may be subject to scheduling, geographic, availability, eligibility, or redemption requirements; andmay have a redemption or expiration deadline when disclosed as part of the applicable promotion.Additional terms provided with a particular giveaway, promotion, donation, or complimentary certificate also apply.Cancellation, rescheduling, weather, and no-show policies may apply once a session is booked.
6. Paid Promotional Session Offers
6.1 General
From time to time, West Oak Photography LLC may offer a photography session at a promotional reservation rate or provide promotional benefits in connection with a paid session reservation.The amount paid reserves or purchases the photography service identified in the applicable offer. A paid promotional session offer is not represented as a general dollar-value gift certificate unless expressly identified as one.Promotional reservation amounts may differ from standard reservation pricing.
6.2 Promotional Benefits
Promotional session offers may include benefits such as artwork credits, priority booking access, waived fees, or other incentives.Unless otherwise stated in the applicable offer:promotional benefits have no cash value;promotional benefits are not redeemable for cash;promotional benefits are not transferable;promotional benefits may not be combined with other promotions, discounts, certificates, or credits;promotional artwork credits may be restricted to specified artwork, products, or collections; andpromotional artwork credits may exclude session reservations, standalone digital photographs, or other specified purchases.No artwork purchase is required unless expressly stated otherwise.
6.3 Promotional Deadlines
A paid session reservation and an accompanying promotional benefit may have different redemption periods.A promotional benefit may require the Client to book or complete a session, place an artwork order, or satisfy another disclosed requirement by a specified date.If a promotional benefit expires because its disclosed requirements are not satisfied, expiration of that promotional benefit does not automatically result in forfeiture of the Client’s paid session reservation unless expressly stated in the applicable offer and permitted by law.
6.4 Offer-Specific Terms
Each promotional session offer may include its own reservation amount, promotional benefits, eligibility requirements, redemption deadlines, artwork restrictions, scheduling requirements, geographic restrictions, or other conditions.Offer-specific terms will be disclosed with the applicable offer or at the time of purchase and are incorporated into these Terms & Conditions.If an offer-specific term conflicts with these general promotional terms, the terms disclosed for that specific offer will control, except where prohibited by law.
7. Artwork, Products, and Digital Photographs
Artwork, products, and digital photographs are generally purchased separately from the session reservation unless specifically included in the applicable session or offer.Prices, product availability, sizes, finishes, collections, and other options are subject to the pricing and product information provided at the time of ordering.Applicable sales tax will be charged on taxable purchases as required by law.Promotional credits, gift certificates, and other credits will be applied in accordance with their applicable terms and applicable law.
8. Payments and Third-Party Services
West Oak Photography LLC may use third-party providers to process payments, manage bookings, deliver galleries, send communications, or provide other business services.When completing a transaction through a third-party provider, you may also be subject to that provider’s applicable terms and privacy practices.Payment confirmations, transaction records, billing information, contact information, and related transaction data may be retained as reasonably necessary for accounting, tax compliance, fraud prevention, customer service, recordkeeping, and other legitimate business purposes.
9. Refunds
Unless otherwise stated in the applicable offer, client agreement, or required by law:session reservation payments are non-refundable;purchased gift certificates are non-refundable;complimentary or promotional benefits have no cash value and are not refundable; andcustom artwork and products are subject to the cancellation, ordering, and refund provisions disclosed in the applicable client agreement or purchase terms.Nothing in these Terms limits any consumer rights or remedies that cannot legally be waived.
10. Service Area and Travel
Sessions generally take place within West Oak Photography LLC’s service area in Southeast Michigan.Certain sessions, certificates, promotions, or offers may specify a geographic radius, designated locations, or other location requirements.Locations outside the normal service area require prior approval and may be subject to additional travel fees.
11. Privacy
West Oak Photography LLC may collect personal information when you use the website, submit forms, make purchases, communicate with West Oak Photography LLC, or use related booking and payment services.The collection and use of personal information is also governed by the West Oak Photography LLC Privacy Policy.
12. Third-Party Websites and Services
This website and communications from West Oak Photography LLC may contain links to or use third-party websites and services, including payment processors, scheduling systems, gallery platforms, email providers, and other service providers.West Oak Photography LLC is not responsible for the content, availability, security, or privacy practices of independent third-party websites or services.
13. Limitation of Liability
To the fullest extent permitted by law, West Oak Photography LLC is not responsible for damages arising solely from website interruptions, technical errors, third-party platform outages, or unauthorized third-party activity outside the reasonable control of West Oak Photography LLC.Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
14. Changes to These Terms
West Oak Photography LLC may update these Terms & Conditions from time to time.Changes will apply prospectively from the posted effective date.Terms applicable to an already completed purchase, purchased gift certificate, or accepted promotional offer will not be retroactively changed where prohibited by law.
15. Governing Law
These Terms & Conditions are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.A dispute concerning a booked photography session may also be subject to dispute-resolution provisions contained in the applicable signed client agreement.
16. Severability
If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
